Capital Punishment

All men are created by God. Hence no men can kill another man. Man by nature is good but circumstances induce or provoke him to kill another human being. For this crime of murder, he is arrested, tried in court and sentenced to death.

Though death sentence is awarded for committing a gruesome murder, it is now questioned whether a man can be derived of his right to live by an order of the court.

Many countries in the world have discussed in detail about the capital punishment. In India also the question of death penalty has been raised as a constitutional issue.

When committing a crime. a person is not in his normal self. But he has to pay the penalty for being emotional. An abnormal parson should be excused tot indulging in anti-social activity.

An eye for an eye and a tooth for a tooth was the ancient law adopted before the advent of civilization. But it is inhuman to kill a man. Before a man is hanged to death, he is put to psychological strain and that by the time he is hanged he almost goes mad.

A Judge who awards the capital punishment is also a human being. Neither the laws nor those who implement the laws are absolutely correct. Any error in fixing the responsibility of a crime upon a criminal may be fatal. Hence it is not wise to award a sentence of death whore a mistake cannot ever be corrected.

There is another argument in favour of death sentence. This will have a deterrent effect on other criminals. The fear of death may make the people avoid the path of crime. It is only for creating tear in the minds of those who want to commit crimes the capital punishment should be maintained. For the existence and well being of the society such, this fear of punishment shall be maintained or people will go astray and destroy the society by their evil deeds.

Though capital punishment is psychologically painful to the individual concerned, yet the entire society should not suffer for a single man or woman.

In countries where capital punishment was abolished it has been re-introduced. In an educationally backward country like India, it takes a long time to make the people social conscious. Hence it is said that the abolition of capital punishment will not help the society, rather do harm to the society by encouraging criminals.

By and large, the general trend in our country is in favour of abolishing the capital punishment. Formerly the death penalty was the rule and the imprisonment for life was the exception. But the present trend has reversed this rule. Now the imprisonment for life is the rule and the capital punishment is only in rare cases where there are exemplary reasons for awarding the same.
